Mediation

What is mediation? 


Mediation is a confidential intervention in dispute negotiations by trained neutral third party for purpose of assisting parties to reach their own solutions. Mediation allows the spouses to negotiate directly with one another with help of the mediator. The Mediator is essential in helping the parties reach reasonable and thoughtful solutions, however, the mediator has no power to make the decisions for the parties. 


Why choose mediation?


  • It is about your family. Rarely are courts the ideal place to solve issues concerning your family, especially when children are involved.


  • You have more control over the process. You have the choice of what issues you want to mediate. This gives you more control on agreements you are willing to enter into.


  • Time and Expense. Typically, litigating your case in court is time consuming and expensive. Mediation allows you to get a resolution quickly and less expensively. Although there is a fee associated with mediation, there is an offset in time for preparation you and your attorney have to spend for a court trial. Above and beyond the time and expense, mediation helps you avoid the emotional distress of a public trial.


  • Confidentiality. You will not have to litigate the issues in an open public courtroom but rather in a private setting before the Mediator.


  • Your voice will be heard. Unlike Court where time is limited and oftentimes you do not have the time or are not allowed to present issues that are important to you, in the mediation process you will have the ability to be heard on all issues – even those that may not be relevant or material.


  • Efficiency. The mediator is available to address emergencies and procedural issues on short notice unlike getting in front of the judge which may require weeks if not months.
